Bag restrictions
We take the safety and security of all of our guests, artists and staff very seriously. Starting on 1st September 2017, visitors will no longer be allowed to bring bags or backpacks into the Mercedes-Benz Arena Berlin.
Guests are permitted to take one small bag/handbag with them which does not exceed the size of “DIN A4” (21.0 x 29.7cm).
There will be designated Fast Lanes for guests who do not bring a bag at all.
Depending on the event, the respective promoter of the show may determine even stricter rules. It’s best to check the event page on our website before your visit for further details.


General Terms and Conditions

General information regarding the Premium Online Shop:
The acquisition of entrance tickets gives rise to contractual relations with regard to the attendance of an event, these existing exclusively between the holder of the ticket (referred to hereinbelow as the “Customer”) and the respective event organizer. There are separate General Terms and Conditions Concerning Tickets (referred to hereinbelow as the “GTCCT”) in place with the event organizer that govern these legal relations, which will apply concomitantly with the General Terms and Conditions for the online ordering system operated by Anschutz Entertainment Group Operations GmbH (referred to hereinbelow as the “GTC”).
Anschutz Entertainment Group Operations GmbH is only involved regarding the event agreement as an intermediary, acting on behalf of the event organizer and on its instructions unless it is itself expressly identified as the event organizer in an individual case. By ordering tickets, the Customer is instructing Anschutz Entertainment Group Operations GmbH to process the purchase of the tickets and to mail them (Versand).

 

I.

Scope of Application

 

The following general terms and conditions shall have exclusive application to the entirety of all contracts awarded to us regarding the delivery of tickets in the relationship with Anschutz Entertainment Group Operations GmbH. Inasmuch as the Customer acquires tickets to suites, the General Terms and Conditions for the Use of Suites in the Mercedes-Benz Arena shall have concomitant application in the relationship between the Customer and Anschutz Entertainment Group Operations GmbH.

II.

Conclusion of the Agreement

1.

The offer to conclude an agreement is made by the Customer upon the Customer completing the order process by booking the ticket(s) desired. With the online confirmation of the order by Anschutz Entertainment Group Operations GmbH, an agreement will come about between the Customer and the respective contractual partner (this being the event organizer or Anschutz Entertainment Group Operations GmbH).

No warranty is assumed for the correctness of the data contained on the online presence of Anschutz Entertainment Group Operations Gmb

III.

Price Components and Payment Procedures

1.

The prices charged for tickets may be higher than the ticket prices printed on the tickets (in this regard, cf. Clause 2 below). Payment may be made exclusively by credit card (Visa or MasterCard). The value-added tax as valid from time to time is included in the price.

2.

In ordering tickets via the internet, a processing fee will be charged that may vary in its amount depending on the event. The postage and shipping services are already included. These fees will be indicated in the shopping cart when an order is placed; above and beyond these fees, no further costs will arise that are not shown. Customers will receive a pro-forma invoice. Upon having received payment, Anschutz Entertainment Group Operations GmbH will mail (Versand) the tickets along with any other elements of contractual performance.

IV.

Rights of Withdrawal, Rights of Return

 

Inasmuch as Anschutz Entertainment Group Operations GmbH is offering services on behalf of the events organizers that appertain to recreational events, and in particular entrance tickets for events, this will not entail a distance contract pursuant to Section 312g paragraph 2 No. 9 of the Bürgerliches Gesetzbuch (BGB, German Civil Code). This means that the right of withdrawal and the right to return, which is in place for two weeks for such distance contracts, does not exist. Accordingly, any order of entrance tickets shall be binding immediately upon being confirmed by Anschutz Entertainment Group Operations GmbH on behalf of the event organizer and shall obligate the Customer to accept delivery of the tickets ordered and to pay for them.

V.

Obligations of the Customer

1.

Please check the tickets delivered to you, immediately upon receiving them, to make sure they correspond to the order you placed; you have the opportunity to inspect your order in the “Service” section of the online shop under “Booking Summary” (Buchungsübersicht). In the event of obviously incorrect deliveries, in particular tickets that have been issued erroneously (wrong seat category, wrong event), you will be issued replacement tickets free of charge, against return of the tickets already delivered, provided you notify us of the error immediately upon having received the tickets. The notification must be in written form; this requirement shall be considered met if you send the notification as to the erroneous delivery by letter to Anschutz Entertainment Group Operations GmbH, Mercedes-Platz 1, 10243 Berlin, or by email to the address (premium@mercedes-benz-arena-berlin.de).

2.

Please inform us by telephone, Mondays thru Fridays between 10:00 A.M. and 6:00 P.M., under 030-206070-8844 or via email under (premium@mercedes-benz-arena-berlin.de) if you have not received the tickets you ordered within ten (10) days after having placed the order, respectively no later than three (3) days prior to the respective event.

VI.

Deposit of Tickets

 

Where the tickets are booked fewer than five (5) days prior to the respective event, the tickets will no longer be sent to you, and instead will be deposited at the event venue for you to pick up personally. For information on the location and date of such deposit, please see the notes published in the Premium Ticket Shop.

VII.

Limitations of Liability, Exclusion of Rescission in the Case of Certain Breaches of Duty

1.

Anschutz Entertainment Group Operations GmbH shall be held liable in each case, without any limitation, in accordance with the Produkthaftungsgesetz (ProdHaftG, German Product Liability Act), for damages caused intentionally or grossly negligently, in the case of any bad-faith failure to disclose defects, as well as for damages resulting from the loss of life, limb, or health. Likewise, the liability for damages resulting from the infringement of a guarantee shall be unlimited.

2.

Where a material contractual duty is breached (so-called cardinal obligations, this being those contractual obligations the fulfillment of which is a necessary prerequisite for the implementation of the contract and on the observance of which the contracting partner may as a rule rely), which breach is based on simple negligence, the liability of Anschutz Entertainment Group Operations GmbH shall be limited to compensation of the foreseeable damage that is typical for the contract concluded.

3.

To the exception of the cases set out in paragraphs 1 and 2, Anschutz Entertainment Group Operations GmbH shall not be liable for damages caused by simple negligence.

4.

The right of the Customer is ruled out to cancel the contract for any breach of duty for which neither the event organizer nor Anschutz Entertainment Group Operations GmbH is responsible and that does not consist of a deficiency of the goods.

5.

Inasmuch as the liability of Anschutz Entertainment Group Operations GmbH has been ruled out or limited in accordance with the above paragraphs, this shall also apply to the liability of the persons it employs in the performance of its obligations or its vicarious agents.

VIII.

Final Clauses

1.

Exclusively the laws of the Federal Republic of Germany shall apply.

2.

The sole place of fulfillment in terms of delivery, performance, and payment shall be Berlin inasmuch as the Customer is a trader within the meaning of Section 14 of the Bürgerliches Gesetzbuch (BGB, German Civil Code).

3.

Where the Customer is a merchant, the exclusive place of jurisdiction (also internationally) for any and all disputes arising directly or indirectly from the contractual relationship shall be Berlin. In the case of cross-border agreements, this shall also apply to non-merchants. Anschutz Entertainment Group Operations GmbH reserves the right to bring the matter before any other court having international jurisdiction.
